Highlights of Rules for Leasing a Home in IronOaks
Conditions for leasing a home are outlined in part in the Rules and Regulations and in Part in the CC&R document. These may be accessed on the website www.ironoakshoa.org
Conditions for Leasing a Home:
- Leases must be for the entire home, including the casita if there is one. A casita cannot be rented separately from the primary residence. This restriction is mandated by Maricopa County Zoning Ordinances.
- A lease must be for a duration of at least 30 days
- At least one tenant must be at least 40 years old; no tenant/resident may be less than 19 years old.
- Leases must be in writing
- A copy of the lease and a list of names and ages of all tenants must be filed with the HOA (Patrol Office)
- Owner(s) must turn in HOA ID card(s) to Patrol for the duration of the lease. Rights to use HOA amenities and facilities are transferred to the tenant. An ID card will be prepared for each tenant.
- The Owner is responsible for being current with payment of all assessments. If more than two tenants will occupy a home, the Owner is responsible for payment of the equivalent of an Associate Member fee (half of the annual assessment).for each additional person. This amount will be prorated for the number of months the tenant occupies the home. I
Responsibilities of Owner
- The Owner/Landlord is liable for all damage caused to HOA property by a tenant, a tenant's visitor or guest, or a tenant's pet. Damages will be assessed against the Owner.
- The Owner is liable for any violation of Rules, Architecture and Landscaping Guidelines or CC&R by a tenant, tenant's visitor or guest. Fines will be assessed against the Owner/Landlord.
- The Owner is responsible for providing the tenant with copies of the Rules and Regulations, Architecture and Landscape Guidelines and CC&R. Requirement for copies may be met either by providing paper copies of the documents themselves or providing a document with instructions for accessing them on the IronOaks web site.
Renter ID card
- Renter ID cards will be issued to all tenants. These cards give tenants access to HOA facilities. Tenants should pick up the cards from the Patrol Office.
RFID/gate cards and Sentex system
- Short term leases (less than 6 months)
- Owner should supply tenant with hand-held RFID card and obtain a tag for the tenant to hang from the rear view mirror
- Sentex (gate entry) system will list Owner's name for the property
- Long term leases (6 months or longer)
- Patrol will assign an RFID (installed or handheld) to the tenant. Tenant should go to Patrol office to arrange for installation or pickup of RFID device. Tenant will be charged $15 per device.
